Abstract
Reliance on the Spiliada framework to determine forum non conveniens pleas by Commonwealth courts (other than Australia) is not justified. A framework that takes into account the realities of different court systems will produce outcomes that are more congruent with the values embodied by the forum non conveniens doctrine.
