Abstract
The paper examines the law of vicarious liability and how its current formulation has largely been driven by broad policy considerations. It argues that the uncertainty in the law stems from a confusion regarding the underlying rationales justifying the imposition of liability. Drawing on these two debates, the paper explores how a universal framework of vicarious liabilitycould look like, with a proper incorporation of policy concerns and grounding rationales.The second volume of papers addressing The Power and Limits of Private Law is based on the third Canadian Law of Obligations conference (“CLO III”) held on June 23-24, 2022, at the University of British Columbia in Vancouver.
