Abstract
It remains difficult to enforce criminal punishment in China due to the following factors: (1) it is difficult to determine the content of trade secrets; and (2) the threshold for initiating a criminal investigation over alleged trade secrets is not uniform throughout China. Recently, China has lowered the threshold of conviction for trade secret crimes and strengthened criminal liability. How are the new provisions to be understood and applied?
