Abstract
The development of the law of unjust enrichment is unique in several respects. First, the law has developed at an amazing pace considering that the House of Lords only officially recognised this cause of action less than 20 years ago in Lipkin Gorman v Karpnale. The second remarkable feature of this branch of law is the great influence of academic thinking in the advancement of the law. Among all the legal scholars who have contributed to the development of the law, Professor Peter Birks must stand out as one of the central figures.3 Together with Robert Goff and Gareth Jones, Birks was one of the modern architects who gave the subject a formal structure through his writings and the legendary graduate seminars at Oxford.
