Abstract

This note, inspired by certain observations made in Addlesee v Dentons Europe LLP [2019] EWCA Civ 1600, discusses their implications for the operation of stare decisis as between the Upper Tribunal and the High Court, and further seeks to illuminate more generally the muddled status of the High Court master within the doctrine of precedent following the Addlesee decision.
