Abstract

With the increased occurance of most-favoured-nations (MFN) clauses in numerous regional or free trade agreements (RTAs or FTAs), bilaterial investments treaties (BITs) and other "economic partnership" arrangements, a fresh issue has cropped up, cam MFN clauses be applied to dispute settlement procedures, as opposed to merely substantive issues.
